These Terms and Conditions reflect the operating mode of Your Store LDA's business. headquartered in Rua da Zona Industrial No 545, 4525-540 Vila Maior, NIF no 513465677, hereinafter referred to as Press Start, as well as the laws applicable to our company and certain aspects that we always believe are true.
As such, these Terms of Use help define the relationship of Press Start with you when you interact with our store.Any changes or updates to these Terms and Conditions will come into effect as soon as they are published in the relevant section of the website
Users are advised to regularly consult the sections of the Terms and Conditions to check the most up-to-date versions. These terms include the following topics:
1. Delivery and Shipping1.1 - Orders of items with immediate availability and made up to the time set in the terms of delivery will be dispatched on the very day, safeguarding unforeseen and logistical impediment.
1.2 - There is currently no possibility of scheduling of delivery of products by hand, all orders must be executed online and all shipments will be by carrier.
1.3 - A Press Start provides the following shipping methods (for Portugal):
- Standard Shipping: We choose the carrier most suited to the shipping characteristics / Fixed shipping cost of €3 for orders under €30 / Free shipping for all orders equal to or greater than €30 / Shipping to mainland Portugal and islands.
- CTT: Logistics fee of 2€ for any value / Fixed cost of 3€ for orders less than 30€ (orders less than 30€ = 5€ Shipping Ports / Orders equal to or greater than 30€ = 2€ Shipping Ports) / Shipping to Portugal Continental and Islands
- CTT Pick-Up: Choose a CTT Point to pick up your order. Fixed cost of 3€ shipping for orders less than 30€ / Shipping to Portugal Continental and Islands
- DPD: Logistics fee of 2€ for any amount / Fixed cost of 3€ for orders less than 30€ (orders less than 30€ = 5€ Shipping Ports / Orders equal to or greater than 30€ = 2€ Shipping Ports) / Shipping to Portugal Continental.
1.4 - For different regions outside Portugal, the carriers presented may differ depending on the respective destination country and the agreements with the carriers in force at the time of the order, as well as the shipping rates that will be available and displayed when checking out the order.
1.5 - A Press Start provides, through email or customer account, tracking and tracking of orders, through the platforms of shipping carriers. All problems of availability, update or faults in the tracking service, will be the responsibility of the carrier and outside the responsibility of Press Start.
1.6 - In exceptional cases, special transport may be required for orders of large volume items. In such cases, the shipping method may undergo changes, as well as the estimated time limits indicated, due to the specificity of the shipping logistics. The customer will be notified of this fact and of the possible change of carrier and its tracking, and no extra fees will ever be charged, regardless of the type of shipping
2. Delivery Time- Continental Portugal: If payment for the order is confirmed by the deadline established in the delivery terms, the order will be sent on the same day, with the expectation that it will arrive on the following business day.There is a delivery time margin of between 1 and 2 business days after the day of shipping confirmation, depending on the logistics and delivery capacity of the carriers, which is beyond our control.Complaints for orders that do not meet the deadlines should be considered from 4 business days after shipping confirmation
- Islands: If the order is addressed to the Portuguese islands the estimate of the delivery time is between 4 to 6 working days, after the day confirmation of shipment of the order. Claims for orders that do not meet the deadlines shall be considered from 10 working days after confirmation of submission
2.1 - All periods mentioned are based on the estimates carried out by the carriers with which we have contract, and Press Start does not carry any kind of transport of goods on its own.
2.2 - Any delay in the delivery of the articles, in the light of the estimated dates presented, does not give the client the right to any immediate compensation, and there should be a complaint and further evaluation of the reason for the delay or non-delivery of the order.
2.3 - A Press Start makes shipment of orders out of Portugal, to countries available in the registration list in the customer account. Customers should check if their country is available in the listing and if there are valid shipping methods when checking out the order. Approximate delivery times as well as shipping costs will be shown upon check-out.
2.4 - A Press Start reserves the right to reject and cancel orders outside Portugal, taking into account possible changes or existing distribution constraints, if it is found that the shipping and shipping conditions are not in conformity. In such cases, customers will be notified and reimbursement of the order shall be no later than 14 (catorze) days from the date of the cancellation notice.
3. Orders3.1 - To make purchases on our website it is necessary to be registered as a customer. After registered you will have the full freedom to make your purchases by adding products to the shopping cart. Because of this, the customer will only have to follow the extremely intuitive and transparent steps referenced on the site in order to validate the purchase.
3.2 - The validation of the purchase order implies that the customer has taken notice and expressly accepts all of these General Terms and Conditions of Press Start.
3.3 - In case of the temporary inavailability of any ordered product Press Start you will contact the customer immediately to solve the problem and offer the best solution available.
3.4 - In case of absolute unavailability of stock of the ordered product(s), the procedure is the refund of the missing item(s). In certain cases Press Start you may propose to the customer the supply of a quality product and equivalent price, since the order with the replacement items will only be processed after the written acceptance (through the digital support platforms) by the customer - this proposal will be dependent on analysis of the logistic process of sending, not being considered if the refund process is communicated.
3.5 - Repayment of the amount paid by the client of the missing item(s) may be made in store credit or by automatic refund through the payment method (at the choice of the customer), in the shortest possible time, within a maximum period of 14 (catorze) days from the date of knowledge of the inavailability of stock.
4. Preserves4.1 - All pre-books are subject to the possible change of official dates by suppliers, and Press Start only indicates the expected date that is initially communicated, being merely speculative.
4.2 - A Press Start is not responsible for any delays or possible failures of distribution by the distributors.
4.3 - In case of postponement of Pre-Book dates, the customer may request cancellation of their order and refund.
4.4 - We work with our suppliers so that we can receive and send pre-book items before the launch date, so that all customers receive the product until the official launch day. However, by impositions of brands and producers, this is not always possible and sometimes we can only send the product on the launch day itself, and it will arrive the next working day.
4.5 - Pre-booking presupposes prior payment for stock management and control. In order to ensure the best service provided for pre-reservation products, the "Submit to Charge" method is not available for any pre-booking product, thus always pre-ordering.
4.5.1 - This condition is applied to the entire order, and if there are articles with immediate availability along with pre-book items, the payment method of "Submission to Charge" will not be available. If you want collection items with immediate availability, you must place separate orders.
4.5.2 - If by any technical or computer failure this condition is exceeded and the "Send to Cobra" is confirmed for a pre-book article Press Start reserves the right not to accept and cancel the order, notifying the customer and proposing to change the payment method.
Five. Payment Methods5.1 - General conditions and payment methods are available in terms of Security Payment.
5.2 - The e-commerce platform Press Start is currently prepared for the following payment methods (valid for Portugal):
- Paypal and Credit Card: Through the link between the website and the platform PayPal. You may associate a credit card with your account PayPal.
- ATM: Payment must be made in an ATM box or homebanking service, by reference provided when order is finished.
- MB Way: Payment must be made through the application MB Way on a smartphone, after entering the associated phone number;
- Bank Transfer: A bank transfer to the IBAN must be executed when ordering - this method is not automatic and requires confirmation.
- Shipment to Collection*: Payment to the delivery at the time of receipt of the order. A fixed fee of 2€ is added.
5.3 - The online store Press Start accept orders and payments for other countries, in accordance with paragraph 2.3. Payment methods available for the different countries will be presented at check-out, with payment per PayPal or by Bank Transfer the most common universal payment methods made available.
* THE Press Start reserves the right not to accept and cancel orders to send the bill to customers who have a history of cancellation of orders or shipments to the rejected collection, which have just returned. In such cases, customers will be notified with the reason for cancellation after evaluation.
6. Orders of various articles (different availability of date and mass items)6.1 - In case of purchase of items with different availability, there will be an evaluation of stocks and the dates of availability to send the order.
6.2 - If the availability of articles exceeds 5 working days Press Start shall send the goods with immediate stock as soon as possible, except:
6.2.1) If the value of the item(s) with immediate availability does not reach the minimum value of the free shipping for the destination Press Start reserves the right to send all articles together as soon as they are available or, if the customer wishes to send them immediately, request and charge the charge of the shipping charges in force, for the article(s) which do not fall within the free shipping policy.
6.2.2) If the availability of articles is less than 5 working days Press Start reserves the right to send the entire order in one shipment, waiting for the availability of the other items.
6.3 - In the case of the order within the same reference with immediate availability articles and articles in Pre-Reserve, or even with different pre-book items with approximate dates, the customer will have to bear in mind that the indicated deadlines are merely speculative, and there may be change of dates and condition the entire shipping process, so it is advised to proceed to different orders for the different article availability. However, we will always try to find and propose a suitable solution to customer interests.
6.4 - If any product has been shipped in advance and does not fall within the Free Ports policy, having the customer enjoying the total order value to obtain free shipping, the shipping value will be charged (€3,00) and discounted in the refund, if the customer subsequently requests the cancellation of the pre-book article.
6.5 - Orders of bulk items may be considered, all orders including 3 or more units of the same product reference, with the same order reference, or separate orders through the same customer account or with the same shipping/stakes data, passing the order(s) to be considered for resale, scalping or possible price and stock speculation. In these cases:
6.5.1) A Press Start reserves the right to reject orders of bulk goods, to avoid fraudulent methods of price manipulation and market.
6.5.2) A Press Start reserves the right to request immediate payment (maximum of up to 24 hours), for bulk goods orders, in order to avoid speculation and possible stock blockage.
6.5.3) A Press Start reserves the right to refuse returns, cancellations or reimbursements of bulk commissioned items, passing the order(s) to be considered for resale purposes, influencing inventory and accounting management.
6.5.4) The loyalty points program is only applicable for private clients. In the case of items ordered in bulk, the loyalty points can be removed by considering that the orders are for the purpose of resale (revendors).
7. Return, Item Exchange and Order Cancellation7.1 - General terms of returns and refunds are available under Guarantees and Returns.
7.2 - The customer is protected by the product warranty law for a period of 3 years, and may also request the exchange according to the law of repentance (according to the products covered by law) until 30 days after receipt of the order. In cases of complaints about considerable damage caused by transport, the customer has up to 14 days to present proof of complaint, after confirmation of receipt of the order.
7.2.1 - For purchases made during the Christmas period (from November 15th to December 24th), the period for requesting exchange or return of the articles extends until January 15th of the following year, if it complies with the conditions below mentioned at the point 7.3. It does not apply for complaints about visible damages - in such cases, the 14-day period remains after confirmation of receipt of the order.
7.2.2 - In the case of return requests for visible damage or imperfections presented in the outer packaging Press Start only if it confirms that the interior of the article is not in the proper conditions of use or is evidently lacking in care in the packaging of the order, having been the cause of considerable damage. The customer has no right to complain to small defects of the outer packaging of the article, which serves as protection of the article, and situations of damage, imperfections or wear of the packaging may occur during the production, storage, shipping or even in the carelessness of the opening of the order, to which the Press Start it's alien.
7.3 - A Press Start cites some conditions of warranty terms, returns and cancellation of orders:
7.3.1) In the event of warranty or return activation, the customer must inform whether the exchange is intended for a similar product or the refund of the value.
7.3.2) Orders returned to the collection will not be accepted.
7.3.3) The customer should make sure that there was no external damage caused by the transport, before opening the article - if the product is opened, the right to claim on external damages is without effect. In the case of returns, orders that present defects caused by transport will not be accepted, so the responsibility for the packaging of the product is the total responsibility of the customer.
7.3.4) The product will have to be in the same shipping state, with all seals intact and that do not show signs of attempted rape.
7.3.5) If the product has been used and/or opened, the right to return is without effect, only applicable for warranty activations;
7.3.6) The customer should be safeguarded with a package tracking system as the Press Start is not responsible for extraviated returns or not delivered.
7.3.7) A Press Start reserves the right to refuse returns, cancellations or refunds of bulk ordered products (3+ units of the same item) with the same order reference, or separate orders through the same customer account or with the same shipping/networks data, passing the order(s) to be considered for resale, scalping or possible price and stock speculation.
7.4 - Only if you return or fully support the shipping values in returns requested by the customer if:
7.4.1) The order has been sent incorrectly by the Press Start. It applies in the event that the product does not correspond to the one presented on the product page or if it has any corresponding characteristic totally incorrect. In the event that there is no information or doubt about any product characteristics, it will be the responsibility of the client to seek the corresponding information before finalizing the order
7.4.2) If the products are defective that makes it impossible to use. If the defect is not obvious and a warranty activation assessment is required, the return costs must be borne by the customer at a first stage and the Press Start required to reimburse return costs if the defect is proven, within the normal parameters of shipping costs.
7.4.3) In case of damage caused by the transport of Press Start for the customer, the customer may request the return for exchange/refund. The costs of sending the return will be borne by the Press Start (if it is on account of the customer, the refund of the amount will be made up to the maximum of the shipping value for the country of origin), only if it is confirmed that the interior of the article is not in due conditions of use or is evident lack of care in the packaging of the order which caused considerable damage. The customer has no right to complain to small defects of the outer packing of the article, which serves as protection of the article, and situations of damage or wear of the packaging may occur during the sending process, either of the Press Start for customer as from the supplier to the Press Start, or even the carelessness of the opening of the order, to which Press Start it's alien. Other compensation methods may be analyzed and proposed, which lack approval from both parties.
7.4.4) In the other cases not mentioned, the customer must always assume the value of the shipping ports, or of sending the Press Start for customer, as from customer to customer Press Start. If the customer has enjoyed the free shipping policy, he/she removes that right, and the amount of the shipment subsequently discounted in the refund.
7.5 - Where the failure is proven to be evident by the seller Press Start should propose a return solution, preferably not charge fees for the customer. If it is not possible, the customer must send and then request a refund of the amount, within the normal parameters of the shipping costs.
7.5.1) By buying online, the customer assumes and recognizes the engaging risks for human, logistics or software failure cases, either by Press Start, as possibly from external entities. In such cases, the impact for the customer should be as little as possible, within the situations provided by law. A Press Start is not required to offer a collection service for any type of return, but must provide a valid address and return point for the shipping country.
7.6 - In the event that the order is returned, by incomplete address or if it is not raised to the collection points after an attempt to deliver it by them, and subsequently returned to our company Press Start reserves the right to charge the costs of the reference. Only in very special cases can there be exceptions.
7.7 - The customer will have the right to cancel the order and request immediate refund if the order has not yet passed the status of "Send" and therefore delivered to the carrier company. In the event that the order is already in the submission process, the cancellation of the order presupposes the return or non-reception of the article, which will activate the return and refund process for the evaluation of the facts.
7.8 - If applicable, the refund of the cancelled order will be made within a maximum of 14 (catorze) days from the date of the cancellation knowledge (in cases where the order has not been sent) or from the day on which the item returns to the premises of the Press Start (in the case of return or not receiving the article).
7.9) If the customer rejects or does not receive the item and the item ends up in the process of returning to the sender, the delivery time back to the shipping place will be dependent on the carrier, and this time limit is beyond the responsibility or control of the Press Start. A Press Start you can only process the exchange or refund of the articles as soon as there is confirmation of receipt at your premises.
Eight. Prices and Products8.1 - The prices presented on the site Press Start are provided in a clear and unequivocal manner, including fees, taxes and discounts presented on the product page, as well as additional shipping charges, postal or delivery expenses or any other charges applicable at the time of check-out of the order.
8.2 - A Press Start it reserves the right, in the event of the occurrence of a computer, manual, technical error or any other source, to cause a substantial change not foreseen in the sale price to the public in your online store, in cases where it is exorbitant or manifestly unrealistic to the market value, to consider the invalid order and to cancel, informing the customer of that fact.
8.3 - Products must correspond to the title of the article. The images presented are merely illustrative and the responsibility of the producers, manufacturers or distributors of the product. All multimedia content associated with the products are supplied or removed from the official channels of communication from suppliers, distributors or publishers, so Press Start is not responsible for the content of the information written on the product page or the images presented.
8.4 - In the event that the images do not correspond to the title of the product clearly, the client must report and question that before finalizing the order, on the risk of the order being considered null by computer error, manual, technical, or of any other origin, also withdrawing validity from the client to complain about the product.
8.5 - In the event that the products do not have full information about their characteristics, the customer cannot assume the characteristics of the product by common sense. In such cases of the absence of any information that the customer considers relevant to his purchase process, he should contact the seller to make sure that the article corresponds to what he seeks. From the moment the customer completes the purchase process, it will be for their responsibility, and the absence of information as justification of claims, refund and return processes is not valid
8.6 - The references of the products presented are for internal control and management, serving only as identification of the product in the online store and to the customer, not necessarily having any kind of connection to the characteristics and origin of the product.
8.7 - A Press Start it is only reseller of the products marketed, having no responsibility for possible technical failures that the products present. In this sense, for technical support and more dedicated customer support, the customer should be aware that the Press Start you will not be able to assume this role, and at the most it will serve as an intermediary for solving problems that are not directly imputed to you, if it is justified.
8.8 - In the case of gifts presented and associated with products, without any extra charge charged (signed as "Offerta"), these are extra and complementary accessories, from the responsibility of suppliers. The toasts will be sent and made available as a courtesy, and there will be no complaint in cases of small damage or signs of wear. A Press Start only accountable for the extra accessories if proven that the mentioned offers have not been included in the shipment. All the gifts identified as "Oferta" are limited to the existing stock, but the customer will be notified in case of stock failure, and the order will always be considered by the item sold and not by the offer toast.
8.9 - In the case of campaigns and promotions in the category "Outlet", the prices of the products presented are only valid for the stock of the current campaign and period, which should be explicit. After the date presented or if the product is sold out during that period, the price to be considered will always be PVP, without any type of discount. In the case of return requests or exchange after the end of the campaign, the price to be considered will be the one at the time of purchase, and may Press Start reject the direct exchange of the product and just assume the refund paid by the customer at the time of purchase.
9. Articles Used9.1 - All used articles go through a quality control process, being tested and conferred on their good condition before being put on sale.
9.2 - All used articles have the indication of "USER" in the product title, a label on the product page and can be found through the filter criteria of the product catalog.
9.3 - A Press Start takes up articles used, depending on evaluation and interest in the products evaluated. The user must contact the Press Start indicating the used products you want to sell, as well as indicate the state of conservation and the available extras and accessories (product box, manual, etc). A Press Start will make an assessment to propose a fair value, depending on the market values.
9.4 - The value of the resumption will be proposed in cash or in client account. You must consult the General Terms of Use Policy to know all conditions
9.5 - For the evaluation of the articles used, the only communication channel available to use is the email dedicated to the effect: used@pressstart. pt
10. Digital Category and Transferable Content (DLC / Updates...)10.1 - The transferable contents are the sole responsibility of the manufacturer. A Press Start is not responsible for the omission or prior use of transferable content in used articles.
10.2 - Software defects are the sole and sole responsibility of the manufacturer. A Press Start is not responsible for them, and their corrections are usually resolved with the updates made available by the manufacturer.
10.3 - A Press Start reserves the right to change at any time your commercial offer presented on: promotions, products, prices, commercial conditions and services.
10.4 - Digital content available on digital platforms Press Start on DLC content are merely illustrative and provided by the manufacturers themselves, and the contents of them should be consulted on the official pages of the brands.
10.5 - All products entered in the Digital Categories do not fall within the Return, Guarantee and Refund policies, and there is thus no possibility to return, exchange or complain about the product.
11. Marketing Campaigns11.1 - A Press Start performs marketing campaigns complying with all the legal criteria of Advertising and Data Protection Regulations, through their social networks (Facebook and Instagram), E-mail Marketing, SMS Marketing, Google Ads, among other regulated and controlled digital platforms, which may be currently in use.
11.2 - A Press Start you can assign Vouchers or Discount Codes to a group of Customers, for purchases on your website. All Vouchers or Discount Codes will not be cumulative with other campaigns unless otherwise stated.
11.3 - All marketing campaigns with discounts, offers or hobbies presuppose compliance with regulations (if they exist) by customers and will be applied according to the instructions published.
12. Fidelization Points12.1 - A Press Start has available a "Fidelization Points" program in which you assign credit (points) to customer accounts as soon as they place a valid order.
12.2 - Products with monetary value in the catalogue Press Start assign points to the order and then to the customer account, save some specific cases ( collector's editions, limited editions, campaigns, etc). The information of the number of points assigned and the respective value in euros is visible on each product page - if the information is not visible, it should be considered that the product is not included in the point assignment program.
12.2.1) For bulk order cases (3+ units of the same article) with the same order reference, or separate orders through the same customer account or with the same shipping/network data, the order(s) are considered for the purpose of resale, scalping or possible price and stock speculation, not being considered valid by the Fidelization Points program.
12.3 - The ratio and calculation of points is worth 0.0125€ per point. That is, every 80 points corresponds to 1€.
12.4 - Points are automatically assigned and are only available in the customer account when the order status passes to the final status of "Send".
12.5 - In the cases of order cancellation, returns or refunds, the points will be withdrawn or considered invalid for the amounts in question, if it is checked and communicates the inconsistency, and may lead to cancellation of orders using these points considered invalid.
12.6 - Points can be redeemed at check-out before selecting the payment method. If the monetary value of the points is higher than the value of the order, only the points equivalent to the value of the order will be deducted.
12.7 - The loyalty points can be used in all product categories, are cumulative with other campaigns in effect and have no expiration date except if:
12.7.1) For some technical reasons or for internal strategy Press Start cancel your loyalty program. In this case, the customer database should be notified via email, within an advance of at least 1 month until the date of cancellation of the program that must be previously established;
12.7.2) The points are thus without binding effect after the period of time indicated in the communication.
12.7.3) The cancellation of the validity of the loyalty points will only be valid for points assigned automatically in orders. In cases of refunds or credits to customers for other reasons, the customer will be entitled to request the amount concerned through another payment method.
12.7.4) A Press Start reserves the right to block or remove the points, if the user of the client account submits any suspicious conduct that aims or effect to act fraudulently against the terms and conditions herein, in violation of good ethical and social conduct or in prejudice to other entities that collaborate directly or indirectly with the Press Start.
12.8) The loyalty points are considered for calculating and assigning the value of the portions or logistic fees. If the value of the order is lower than the amount applicable to free shipping, the fee will be added by applying the value in force. That is, if, for example, the total value of the points covers the entire order value, the extra shipping fees will always be applied.
13. Use of Cookies13.1 - A Press Start uses cookies to collect information about how visitors use your website. These actions are performed anonymously and regulatedly.
13.2 - By accepting cookies policy Press Start you should note that the use of cookies makes it possible to customize the use and presentation of services and offers adapted to your interests. Cookies settings can be changed at any time.

14. Guarantee Post-Sales14.1 - In accordance with Decree-Law No84/2021, which was published in the Diário da República in accordance with the directives of the European Union (770 and 771 of 2021), all new equipment acquired in Press Start have 3 years of warranty, except for the products "USADOS", which will have a warranty period established by the seller.
14.2 - In case of breakdown, defect or damage of the product, the customer must contact the Press Start for the resolution of the problem, except the following cases:
14.2.1) Absence of valid purchase proof;
14.2.2) Clear damages of negligence and misuse of the product;
14.2.3) Change or violation of the normal status of the product;
14.2.4) Absence of original packaging;
14.2.5) In the case of guarantees of certain licensed products, these must be activated with the manufacturers themselves (Ex: Consoles and Commands Nintendo, Commands Playstation, etc.) – In these cases we will give technical support to open complaint, being the follow-up of the complaint and warranty process outside the responsibility of Press Start.
14.3 - In most cases, if all warranty activation conditions are ensured, the products will be sent to the official suppliers of the products that will make the technical evaluation and the respective resolution of the problem, and Press Start will not have the authority to override the resolution of official product representatives.
14.4 - A Press Start does not make the repair of the products, however it may make the technical evaluation through its professionals to evaluate the possibility of immediate exchange of the product, having immediate stock existence, if the anomaly is evident
15. Liabilities15.1 - All products sold on the pressstart website. in accordance with the portuguese legislation in force.
15.2 - A Press Start is not responsible for damages arising from interruptions, interferences, computer viruses, breakdowns or disconnections of the operating system that may temporarily prevent access to navigation or the provision of services by users.
15.3 - A Press Start rejects any liability in the event of violation of the law of the country where the order is delivered. It is for the customer to check with the local authorities the conditions for the import or use of the products they wish to order.
16. Client and User obligations16.1 - The users of the pressstart website. they undertake to respect and comply with these General Conditions of Use, in particular:
16.1.1) Do not introduce or spread on communication platforms Press Start, defamatory, obscene, injurious, xenophobic and/or any other party violating the general principles of law and public order;
16.1.2) To provide reliable personal data and a valid and complete address, so that the Press Start can process and deliver the orders correctly. All data entered are confidential and used only for the purpose to which they are dedicated;
